• ANNEX 1 - MANDATORY CONDITIONS

   

  Any person carrying out security activities on these premises must be licensed by the Security Industry Authority.

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours means:

  Those detailed on this licence and on New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day.

   

  Restrictions

   

  The above restrictions do not prohibit:

  a)              during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;

  b)              during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  c)              during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;

  d)              the supply to, or consumption by, any person of alcohol in any premises where they are residing.

   

  Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal.

   

  The Club shall operate in accordance with the rules submitted with the application.

   

  No alteration shall be made to those rules concerning, the election of members, the sale or supply of alcohol or the use of the premises without the prior consent of the Licensing Authority.

   

  Any other alteration to the rules shall be notified to the Licensing Authority and Police within 28 days.

   

  The premises will be a member of Pubwatch and a representative will attend Pubwatch meetings and participate in all initiatives.

   

  The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.

   

  The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.

   

  The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.

   

  All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.

   

  The maximum occupancy figures for the premises will made in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.

   

  There will be in place, adequate supervision of the entrance lobby throughout the trading hours.

   

  A proof of age policy to the satisfaction of the police and the Local Authority will be in place.

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  To prevent entertainment being intrusive, noise emanating from the premises would not be clearly distinguishable above other noise one metre from the facade of the nearest residential property.

   

  Management would retain the responsibility and control of sound levels of the music/entertainment.

   

  All external doors would be kept shut and windows locked in accordance with fire regulations other than for access or egress in all rooms, when events take place involving amplified music or speech or other entertainment likely to give rise to noise.

   

  The fire doors to be alarmed.

   

  A telephone to receive any complaints about noise to be operational and supervised during all functions where amplified music was played or live music was performed.

   

  Music will be reduced to background level half an hour before closing to allow people to relax, aclimatise and adjust their hearing.

   

  No music or speech will be played by external speakers without the consent of the Licensing Authority.

   

  No music or entertainment will be permitted in the open air or in a marquee in the grounds of the premises without the consent of the Licensing Authority.
