ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Alcohol can be sold from the end of permitted hours on New Year's Eve until the start of permitted hours on the following day.
Alcohol can be sold and regulated entertainment can be provided from the end of permitted hours on the Sunday prior to a Bank Holiday Monday until 2.00am. However, outdoor regulated entertainment must cease at 10.00pm.
The premises will be a member of Pubwatch and a representative will attend Pubwatch meetings and participate in all initiatives.
Crime prevention notices will be displayed warning customers of the prevalence of crime which may target them, eg “bags should not be left unattended”, “watch out for pickpockets”, drugs awareness etc.
A detailed “customer code of conduct” poster will be displayed warning customers that if they act in an inappropriate manner, they could be barred from all licensed premises in the vicinity.
All staff have received suitable training in licensing law, what to do in an emergency and in general safety precautions.
Door supervisors will display the correct name badge and will carry proof of registration.
Door supervisors will be used at a ratio to be agreed by the Police and Local Authority, which is currently 1:75.
A female door supervisor will be available if searches are to be conducted on female customers.
An incident book will be kept and details of all instances of public disorder will be recorded.
When entertainment is provided inside the capacity of 200 persons will not be exceeded.
When the premises are open until 02.00am, entry will only be allowed until 12.00 midnight.
An anti drug policy agreed by the Police and local authority will be in force.
A secure facility to store controlled drugs will be available.
CCTV will be maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
Recordings will be maintained for an appropriate period of time (generally one month- but to be agreed with Police & Local Authority).
If the CCTV equipment is inoperative, the Police & Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
CCTV will be registered under the Data Protection Act 1998 with the Information Commissioner.
An appropriate method for checking the number of people entering and leaving the premises will be used and steps will be taken so that, once the maximum occupancy is reached, no further persons are admitted.
No customers carrying open bottles or glasses will be admitted to the premises at any time.
No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
All bottles and glasses will be removed from public areas as soon as practicable when they are finished with.
Irresponsible drinks promotions will not be permitted.
The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
Toilets and cisterns will be checked during the day's trading to check for drug use and dealing.
The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
Free drinking water will be available at all times.
There will be adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons at all times.
Suitable protective equipment will be provided to deal with hypodermic needles, blood spillages and other body fluids. Procedures will be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable diseases.
Regular glass and bottle collection will be undertaken throughout opening hours.
All external doors and windows will be kept shut, other than for access and egress in all rooms when events involving amplified music or speech or other entertainment likely to give rise to noise.
A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
Management will control the sound levels of the music / entertainment.
Chill Out Time. Music will be reduced / switched off half an hour/an hour before closing time to allow people to relax, acclimatise and adjust their hearing.
The entrances are provided with lobbies with automatic door-closers. The lobbies are in use throughout the time of entertainment.
Emergency exits will be well fitted and kept shut during opening hours.
Suitable signage at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
Door staff will be positioned at exits at closing time and will patrol the car park at the end of the night to ensure orderly and quiet dispersal.
The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside the buildings.
The site is to be checked each morning for rubbish from these premises and from food outlets on the motorway services opposite. All the rubbish produced by the premises will be stored securely in a designated area in a wheelie bin with a tight fitting and lockable lid.
The performance of any music outdoors in the summer months is to be controlled by noise limiters and is to cease at 10.00pm so as not to be offensive to neighbours. Any further entertainment on these nights is to continue inside.
Any person who appears to be aged under 21 will be asked for identification if attempting to purchase alcoholic drinks.
Identification that will be accepted are: A valid passport, photographic driving licence or approved identification card carrying PASS logo.
No persons under 18 years to remain on the premises after 10.00pm unless the area has been totally booked and allocated to a private function (eg. Wedding reception).
Conditions offered for the performance of live or recorded music in the gardens
a) to perform regulated entertainment on any weekend from 1st May to the last August bank holiday.
b) that performance of music will not begin before 10.00am and is to end by 10.00pm.
c) that noise limits will be agreed with Environmental Health Services and limiters will be in use.
d) that management will check through the course of an event that residents are not being inconvenienced.
e) that residents in the area will be advised of any event at least one week in advance.
f) that the police will be advised at least one week in advance.
g) that sufficient SIA registered staff will be on duty at a ratio of 1:75 persons to ensure that all four licensing objectives are achieved.
h) that a registered first aider will be on duty.
i) that extra exterior lighting will be available.
j) that extra measures for fire fighting, sand buckets, extinguishers etc will be located close to staff outside.
k) that glassware will be substituted for plastic for exterior events.
l) that bottles will not be allowed to be taken outside.
m) that if sufficient numbers are expected (eg The WearyFest) portacabin toilets will be hired to allieviate any ablution issues.
n) that CCTV cameras will cover the garden, and are recording.
o) that extra bins will be in place to collect rubbish.
p) that food will be available at all times.
q) that free fresh water will be available.
