ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
a) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, Monday to Thursday 10.00am to 11.00pm, Friday and Saturday 10.00am to 01.00am, Christmas Eve 10.00am to Midnight.
b) On Sundays, other than Christmas Day or New Year’s Eve, noon to 10.30pm
c) On Good Friday, 10.00am to 12.30pm
d) On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:
i. not exceed six and a half hours;
ii. not begin earlier than noon;
iii. not end later than 10.30 p.m.
iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v. not extend for more than three and a half hours after 5 p.m.
e) On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day.
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
b) during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
c) during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
d) the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal.
A detailed “member code of conduct” poster will be displayed warning members that if they act in an inappropriate manner, they could be barred from all licensed premises in the vicinity.
The premises will be a member of Pubwatch and a representative will attend Pubwatch meetings and participate in all initiatives.
The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
The maximum occupancy figures for the premises will be 100 in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.
A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
Management will control the sound levels of the music / entertainment.
Suitable signage at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
