ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Tiverton Town Council will do all in their power to ensure the safety and welfare of its staff and users of the facilities of the New Hall at all times.
The Council will conduct regular risk assessments and take necessary action from the results of those assessments. It will comply with health and safety legislation and, as far as is reasonably practicable, good practices and ACOP’s that are relevant to the identified risks.
It will do all in its power to prevent crime and disorder, protect children from harm and prevent public nuisance.
Door supervisors will display the correct name badge and will carry proof of registration.
A female door supervisor will be available if searches are to be conducted on female customers.
Door supervisors will wear clothing that can be easily and clearly identifiable on CCTV - ie wear a reflective number between 1 and 99 (at least 100mm high) in a prominent position on the upper part of the body.
Door staff will be position at exits particularly at closing times.(Door staff should be instructed to encourage patrons to move on as quietly as possible. If no door staff are employed the licensee or a suitable member of staff should undertake this role)
CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
Recordings will be maintained for an appropriate period of time (generally one month- but to be agreed with Police & Local Authority).
If the CCTV equipment is inoperative, the Police & Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
CCTV will be registered under the Data Protection Act 1998 with the Information Commissioner.
No customers carrying open bottles or glasses will be admitted to the premises at any time.
No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
A proof of age policy to the satisfaction of the police and the Local Authority will be in place.
An anti drug policy agreed by the Police and local authority will be in force.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
The maximum occupancy figures for the premises will be made in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.
When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
Sufficient numbers of door staff / stewards who are suitably trained will be provided on the premises, depending on the activities or entertainment taking place on site and the likelihood of overcrowding.
The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
All external doors and windows will be kept shut, other than for access and egress in all rooms when events involving amplified music or speech or other entertainment likely to give rise to noise.
An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
A proof of age policy to the satisfaction of the police and the Local Authority will be in place.
The internal arrangement of the premises including all seating and standing areas for spectators will be agreed with the licensing authority to minimise the risks to the spectators and participants.
Reasonable precautions will be taken to minimise the risks to spectators or participants from any equipment used in the entertainment.
Where recommended by sporting governing bodies of other responsible bodies an appropriately registered medical practitioner(s) shall be present throughout the sports entertainment.
A registered medical practitioner or a registered paramedic shall be present at any event involving boxing, wrestling, judo, karate, kickboxing or other similar sports entertainment.
Suitable dressing room accommodation will be provided with washing facilities for the participants.
When a ring is to be used it will be sited and constructed as agreed with the licensing authority.
At wrestling or other entertainment of a similar nature, where performers can be potentially ejected from the ring, members of the public will not sit within 2.5 meters of the ring.
