ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air.
SIA Door supervisors will be employed at a rate of 1:75 when pre-arranged Licensable Entertainment takes place.
Amplified music will be played in the function room only.
The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
The maximum occupancy figures for the premises will be in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.
Suitable signage at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
A senior member of staff (manager) will assess the impact of any amplified entertainment on neighbouring residential premises at the start of the entertainment and periodically throughout the entertainment.
A dedicated Incident Book will be kept on the premises and available for inspection by enforcement bodies. The Incident book will detail all Incidents that are likely to impact upon any of the four licensing objectives, refusal of service or entry to the premises and Challenges made in line with the venues age verification policy
Records will be kept detailing Persons banned from the premises with reasons and length of ban. Staff will be advised of details of these persons.
The DPS or their representative will attended Local Pub watch meetings, partake in initiatives and support bans made by the pub watch scheme.
CCTV will be installed complying with an operational requirement assessment conducted by Mid Devon District Council.
A CCTV system will be operated and maintained on these premises in accordance with Mid Devon District Council’s CCTV Operational requirement document for licensed premises. This document will be completed in consultation with the police and the licensing authority to show the required positioning of all CCTV cameras and CCTV hardware for the premises.
The CCTV agreement within this Operational Requirement document will be signed and dated by the premises licence holder or a person authorised to sign on behalf of the premises licence holder.
The signed CCTV agreement and the completed CCTV operational requirement document or a true copy of the document/s will be maintained at the premises available for inspection by a police officer or an authorised officer of the licensing authority at any reasonable time.
Alterations to the CCTV system that affect the positioning of the CCTV cameras or the quality of the recorded images must be notified to the licensing authority who will undertake a new operational requirement assessment. No alterations to the CCTV system will take place unless agreed by the licensing authority who will document the changes to the CCTV system in an updated operational requirement.
In the event of a partial or total failure of the CCTV system or any component within the CCTV system the Licensing authority will be notified as soon as possible of the failure. The Licensing authority must be notified no later than the end of the next working day following discovery of the system failure.
Following total or partial failure of the CCTV system the Licensing authority, who will consult with the police, will set out the steps the premises licence holder must take to ensure the licensing objectives are not compromised during the period the CCTV system is in a state of total or partial failure. These steps will be set out in writing and given to the licence holder.
On a Friday and Saturday evening from 21.00 until close of business two members of staff will be on duty within the premises.
On Friday and Saturday evening from 21.00 until close of business a personal licence holder will be on duty within the premises.
