ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
PART 1
1. No film shall be exhibited unless:
a) It has received a “U”, “PG”, “12”, “15” or “18” certificate of the British Board of Film Classification; or
b) It is a current newsreel which had not been submitted to the British Board of Film Classification.
2. No person apparently under the age of 18 years shall be admitted to any exhibition at which there is to be shown any film which has received an “18” certificate from the British Board of Film Classification.
3. No person apparently under the age of 15 years shall be admitted to any exhibition at which there is to be shown any film which has received a “15” certificate from the British Board of Film Classification.
4. No person apparently under the age of 12 years shall be admitted to any exhibition at which there is to be shown any film which has received a “12” certificate from the British Board of Film Classification.
5. Notwithstanding the conditions herein before contained, a film may be exhibited or persons or any class of persons, may be admitted thereto if the permission of the licensing authority is first obtained and any conditions of such permission are complied with.
6. A representation or written statement of the terms of any certificate given by the British Board of Film Classification shall be shown on the screen immediately before the showing of any film to which it relates and the representation or statement shall be shown for long enough and in a form large enough for it to be read from any seat in the auditorium.
7. There shall be prominently exhibited at each public entrance whenever the premises are open to the public a notice indicating in tabular form and in clear bold letters and figures:-
a) the title of each film to be shown on that day, other than trailers and films of less then 5 minutes duration;
b) the approximate times of commencement of each such film;
c) whether each such film has received a “U”, “PG”, “12”, “15” or “18” certificate of the British Board of Film Classification, and
d) the effect of such “U”, “PG”, “12”, “15” or “18” certificates in relation to the admission of persons under the age of 18 years.
8. The nature of any certificate received in respect of a film from the British Board of Film Classification shall be clearly indicated by the figure “U”, “PG”, “12”, “15” or “18” in any advertisement of the film displayed at the premises.
9. No advertisement displayed at the premises of a film to be exhibited at the premises shall depict as a scene or incident in the film any scene or incident which is not included in the film as certified by the British Board of Film Classification or approved for exhibition by the licensing authority, as the case may be.
10. When children are present at any “Universal” exhibition of films no trailer shall be shown advertising an “18” film.
11. Where the licensing authority has given notice in writing to the licensee of the premises prohibiting the exhibition of a film on the grounds that it contains matter which if exhibited, would offend against good taste or decency or would be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that film shall not be exhibited in the premises except with the consent in writing of the licensing authority.
12. For the purposes of this licence “film” means any exhibition of moving pictures produced otherwise than by the simultaneous reception and exhibition of television programmes broadcast by the British Broadcasting Corporation or the Independent Broadcasting Authority included in a cable programme service which is or does not require to be licensed by the Cable Authority under Section 4 or the Cable Broadcasting Act 1984.
13. If the licensing authority do not agree with the category in which any film passed by the British Board of Film Classification is placed, they shall be at liberty to alter such category, and, on notice of such alteration being given by the licensing authority to the licensee, the film thereafter shall be treated as having been placed in the altered category and the conditions applicable to the exhibition of films in such altered category shall be complied with.
14. If the licensing authority request the licensee to exhibit to them any film, he shall do so at such reasonable time as the licensing authority may, in writing, direct.
15. The said Licensee shall comply with the requirements of Part III of the Cinematograph (Safety) Regulations 1955 (which relate to films not exceeding sixteen millimetres in width).
16. A copy of the Cinematograph (Safety) Regulations 1955 shall be exhibited in the said premises so that they can easily be seen by members of the staff.
PART 2
Fire Procedures
17. A fire routine appropriate to the premises shall be devised.
18. All persons employed to work in the premises and any ushers or stewards not so employed shall be given instruction and training in what to do in case of fire.
19. The Licensee shall ensure that one specific person shall be made responsible for organising the training of staff and any non-staff ushers or stewards that may be used and the same person shall be responsible for co-ordinating the actions to be taken in the event of fire. Effective arrangements shall be made for a nominated deputy to carry out the above duties.
20. In the case of any outbreak or suspected outbreak of fire, the Devon Fire and Rescue shall be called immediately.
21. A conspicuous notice clearly stating the location of the nearest telephone and the correct method of summoning the Fire Authority shall be displayed in the foyer of, or entrance to, the premises.
22. All means of escape, i.e. corridors, gangways, passages, stairways, exit ways, etc., shall be kept free from obstruction at all times when members of the public are on the premises.
23. All stairs and steps shall be maintained with non-slippery and even surfaces and any stair coverings shall be secured and maintained so that they will not in any way be a source of danger to person escaping in case of fire.
24. A log book shall be kept in which there shall be recorded details of tests and maintenance of fire fighting equipment, fire warning system (where applicable) and emergency lighting and the dates on which staff, stewards or ushers received training in the actions to be taken in case of fire.
25. All fire fighting equipment with which the premises are provided shall be maintained in efficient working order.
26. The fire warning system (if provided) shall be maintained in efficient working order.
27. The Fire Officer’s recommendations (if any) shall be strictly observed.
PREMISES
Electrical
28. The Licensee shall furnish to the Licensing Authority annually at the time of renewal of the Licence a Certificate as to the condition of the electrical installation with which the premises are provided. The Certificate to be signed by a competent electrician, preferably one who is a member of the National Inspection Council for Electrical Installation Contracting or the Electrical Contractors Association.
29. Any alterations, modifications or extensions to the electrical installation with which the premises are provided shall be carried out by a competent electrician and shall be strictly in accordance with IEE Regulations and any portable electrical equipment or appliances used in the premises shall be in efficient working order and correctly wired and connected.
30. Residual current devices sensitive to tripping currents or not more than 30 milliamps must be fitted to cover all socket outlets that could be used to plug in portable electric equipment. Residual current devices should comply with British Standard 4293.
31. The emergency lighting with which the premises are provided shall be maintained in efficient working order and be in operation during the whole time the public are in the premises. The existing system must illuminate all exit signs, doorways, steps and passages forming exit routes from the licensed premises and any other part of the premises specified in the schedule of conditions and shall be independent of the normal lighting system. Oil lamps and candles shall not be used.
Building
32. Before carrying out any alterations to the premises, including the wall and ceiling linings, or any material alterations in the internal arrangement of the premises or in the furniture or equipment with which the premises is provided, 28 days’ written notice must be given the Licensing Authority and to the Fire Authority.
33. If the Licensee shall cause to be erected in the auditorium, scaffolding for the purpose of decoration or otherwise, he shall, while the work is in progress, cause the ceilings to be thoroughly examined by a fully qualified Architect or Civil Engineer and shall forward to the Council a certificate in the form prescribed by the authority, signed by the said Architect or Civil Engineer concerning the condition of the ceiling. (Note: The Council will require such a certificate once in every period of five years, whether or not decoration, etc. is undertaken during that period.)
34. All “Exit” signs shall be maintained in a good state of repair.
35. Any doors required to be fire resisting shall be effectively maintained and where such doors are also required to be self-closing they shall be maintained as such and shall be provided with no means of holding them in the open position, other than automatic releases where these have been specifically approved by the Licensing Authority.
36. (a) The doors of any doorway through which persons might be to pass so as to get out of the premises shall be capable of being easily and immediately opened without the aid of a key at all times when members of the public are on the premises.
(b) All doors fitted with panic bolts or latches shall be indicated by the words “PUSH BAR TO OPEN” in 4” (100mm) block letters in a distinctive colour, preferably white letters on a green background.
Fire Hazards
No explosive or highly inflammable material shall be brought into the premises and any curtains, drapes or other decorative materials introduced into the premises shall either be inherently non-flammable or comply with BS 5867:Part 2, Type 2.
No portable heating appliances shall be permitted on the premises during the time they are used for the purpose to which this License applies.
PLEASE NOTE:
The Council may revoke any or all of these conditions or impose new or additional conditions at any time during the currency of this licence.
The maximum number of persons to be permitted on the premises is not to exceed 304.
