ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. No film shall be exhited unless:
a) it has received a "U", "PG", "12", "15" or "18" certificate of the British Board of Film Classification; or
b) it is a current newsreel which had not been submitted to the British Board of Film Classification.
2. No person apparently under the age of 18 years shall be admitted to any exhibition at which there is to be shown any film which has received an "18" certificate from the British Board of Film Classification.
3. No person apparently under the age of 15 years shall be admitted to any exhibition at which there is to be shown any film which has received an "15" certificate from the British Board of Film Classification.
4. No person apparently under the age of 12 years shall be admitted to any exhibition at which there is to be shown any film which has received an "12" certificate from the British Board of Film Classification.
5. Notwithstanding the conditions herein before contained, a film may be exhibited or persons or any class of persons may be admitted thereto if the permission of the Licensing Authority is first obtained and any conditions of such permission are complied with.
6. A representation or written statement of the terms of any certificate given by the British Board of Film Classification shall be shown on the screen immediately before the showing of any film to which it relates and the representation or statement shall be shown for long enough and in a form large enough for it to be read from any seat in the auditorium.
7. There shall be prominently exhibited at each public entrance whenever the premises are open to the public a notice indicating in tabular form and in clear bold letters and figures:-
a) the title of each film to be shown on that day, other than trailers and films of less than 5 minutes duration;
b) the approximate times of commencement of each such film;
c) whether each such film has received a "U", "PG", "12", "15" or "18" certificate of the British Board of Film Classification, and
d) the effect of such "U", "PG", "12", "15" or "18" certificates in relation to the admission of persons under the age of 18 years.
8. The nature of any certificate received in respect of a film from the British Board of Film Classification shall be clearly indicated by the figure "U", "PG", "12", "15" or "18" in any advertisement of the film displayed at the premises.
9. No advertisement displayed at the premises of a film to be exhibited at the premises shall depict as a scene or incident in the film any scene or incident which is not included in the film as certified by the British Board of Film Classification or approved for exhibition by the Licensing Authority, as the case may be.
10. When children are present at any "Universal" exhibition of films no trailer shall be shown advertising an "18" film.
11. For the purposes of this Licence, "film" means any exhibition of moving pictures produced otherwise than by the simultaneous reception and exhibition of television programmes broadcast by the British Broadcasting Corporation or the Independent Broadcasting Authority included in a cable programme service which is or does not require to be licensed by the Cable Authority under Section 4 or the Cable Broadcasting Act 1984.
12. If the Licensing Authority do not agree with the category in which any film passed by the British Board of Film Classification is placed, they shall be at liberty to alter such category, and, on notice of such alteration being given by the Licensing Authority to the Premises Licence Holder, the film thereafter shall be treated as having been placed in the altered category and the conditions applicable to the exhibition of films in such altered category shall be complied with.
13. If the Licensing Authority request the Premises Licence Holder to exhibit to them any film, he shall do so at such reasonable time as the Licensing Authority may, in writing, direct.
14. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
15. Recordings will be maintained for an appropriate period of time (generally one month- but to be agreed with Police & Local Authority).
16. If the CCTV equipment is inoperative, the Police & Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
17. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
18. CCTV will be registered under the Data Protection Act 1998 with the Information Commissioner.
19. Sufficient numbers of door staff / stewards who are suitably trained will be provided on the premises, depending on the activities or entertainment taking place on site and the likelihood of overcrowding.
20. All persons employed to work in the premises and any non-staff ushers or stewards shall be given instruction and training in what to do in case of an emergency and general safety precautions.
21. The Premises Licence Holder shall ensure that one specific person shall be made responsible for organising the training of staff and any non-staff ushers or stewards that may be used and the same person shall be responsible for co-ordinating the actions to be taken in the event of an emergency. Effective arrangements shall be made for a nominated deputy to carry out the above duties.
22. All means of escape, ie corridors, gangways, passages, stairways, exit ways, etc, shall be kept free from obstruction at all times when members of the public are on the premises.
23. All stairs and steps shall be maintained with non-slippery and even surfaces and any stair coverings shall be secured and maintained so that they will not in any way be a source of danger.
24. There will be adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons at all times.
25. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
26. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30mA and should comply with BS 4293. The device will be tested monthly and tests will be recorded.
27. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
28. When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
29. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
30. The maximum number of persons to be permitted on the premises is not to exceed 304.
