ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means: the hours granted by this variation application
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
b) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c) during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f) the sale of alcohol to a trader or club for the purposes of the trade or club;
g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h) the taking of alcohol from the premises by a person residing there; or
i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.
Alcohol may be sold or supplied at any time:
a) on premises which are bona fide used, or intended to be used, for the purpose of habitually providing for reward board and lodging, including breakfast and at least one other customary main meal;
b) subject to the condition that alcohol shall not be sold or supplied on the premises otherwise than to persons residing there or their private friends bona fide entertained by them at their own expense, and for consumption by such a person or his private friend so entertained by him either on the premises or with a meal supplied at but to be consumed off the premises.
c) there must be adequate sitting accommodation in a room not to be used for sleeping accommodation for the service of substantial refreshment or for the supply or consumption of alcohol.
CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
Recordings will be maintained for an appropriate period of time (generally one month- but to be agreed with Police & Local Authority).
If the CCTV equipment is inoperative, the Police & Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
CCTV will be registered under the Data Protection Act 1998 with the Information Commissioner.
When live and recorded music/dance takes place for the general public SIA registered door supervisors will be employed at a ratio of 1:75.
There will be adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons at all times.
The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
The maximum occupancy figures for the premises will be determined in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.
All external doors and windows will be kept shut, other than for access and egress in all rooms when events involving amplified music or speech or other entertainment likely to give rise to noise.
An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
Emergency exits will be well fitted and kept shut during opening hours.
Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.
Management will control the sound levels of the music / entertainment.
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the façade of the nearest residential property.
Chill Out Time. Music will be reduced half an hour before closing time to allow people to relax, acclimatise and adjust their hearing.
The use of gardens and external play areas will not commence before the start of normal trading hours and will cease at dusk or at 21.00 hours, whichever is the earlier.
No music or speech will be relayed by external speakers without the consent of the licensing authority.
Ventilation equipment will be regularly cleaned and maintained to control the levels of odour generated by the premises.
A proof of age policy to the satisfaction of the police and the Local Authority will be in place.
