ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Alcohol can be sold and regulated entertainment provided on Bank Holiday weekends, Thursday to Monday 10.00am until 00.30am.
Alcohol can be sold and regulated entertainment provided on the penultimate Saturday before Christmas from 11.00am until 00.30am.
Alcohol can be sold and regulated entertainment provided from the end of permitted hours on New Year's Eve until the start of permitted hours the following day.
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.
Alcohol may be sold or supplied at any time:
a) on premises which are bona fide used, or intended to be used, for the purpose of habitually providing for reward board and lodging, including breakfast and at least one other customary main meal;
b) subject to the condition that alcohol shall not be sold or supplied on the premises otherwise than to persons residing there or their private friends bona fide entertained by them at their own expense, and for consumption by such a person or his private friend so entertained by him either on the premises or with a meal supplied at but to be consumed off the premises.
c) there must be adequate sitting accommodation in a room not to be used for sleeping accommodation for the service of substantial refreshment or for the supply or consumption of alcohol.
The premises in general will continue to operate in order to promote the Licensing Objectives.
The premises will continue to operate the previous arrangements in order that the 'Prevention of Crime and Disorder' objective is promoted.
The premises will continue to operate the previous arrangements in order that the 'Public Safety' objective is promoted.
The Designated Premises Supervisor will maintain in good working order the fire safety measures with which the premises are provided.
The Designated Premises Supervisor will carry out a regular fire risk assessment in accordance with Fire Precautions (Workplace) Regulations.
Consideration will be given to setting capacity limits to prevent overcrowding which could lead to crime and disorder. This capacity figure will be based on advice from the Police, Fire or local authority.
All bottles and glasses will be removed from public areas as soon as practicable when they are finished with.
There will be adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons at all times.
The manager or senior member of staff check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
The maximum occupancy figures for the premises will be in agreement with the Council and Devon Fire & Rescue based on fire safety issues, available floor space and the sanitary accommodation available.
The premises will continue to operate the previous arrangements in order that the 'Prevention of Public Nuisance' objective is promoted.
There will be a 30-minute drinking-up time prior to the premises closing when alcoholic beverages will not be supplied.
Suitable signage at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
Management will control the sound levels of the music / entertainment.
The premises will continue to operate the previous arrangements in order that the 'Protection of Children from harm' objective is promoted.
A proof of age policy to the satisfaction of the police and the Local Authority will be in place.
